residency obligations

There are several requirements in order to maintain your permanent resident status. Generally, this refers to being physically pr in Canada and you must have been in Canada for at least 730 days during the last five years. However, there are exceptions to this rule.

If you have been in Canada for longer than 5 years, the assessment period will be based on the 5-year period prior to the day that the application was received by IRCC.

Either when you are renewing your permanent resident card, applying for citizenship, or a permanent resident travel document, you will be asked to detail your time spent in Canada and abroad. A determination will be made whether you have met your residency obligations.

Failing to meet your residency obligations can result in a loss of permanent resident status, however, this only occurs once a determination has been made. Until that point, you remain a permanent resident.

It is possible to renounce your permanent resident status if you realize that you will not be able to meet your residency obligations. You should speak to a professional and understand the ramifications of renouncing your status.

You should also speak to a professional if you anticipate having a long absence from Canada.
